What happens if I don’t comply with GPSR?
If you fail to comply with the GPSR regulations, you could face penalties from EU authorities, including product recalls, fines, and potential bans on selling non-compliant products in the EU.
While Amazon itself may not directly suspend your store, non-compliance could lead to the removal of listings or accounts being flagged, especially if your products are found to pose a safety risk or if you cannot provide the necessary documentation when requested.
Why must we appoint a responsible person and can this role be fulfilled by a friend?
According to GPSR must appoint a qualified responsible person in the EU for compliance with local regulations. This role can be fulfilled by a registered entity or a qualified individual, but not typically by a friend or simple a mailbox without relevant expertise. While Amazon, Ebay or other marketplaces will accept just any type of EU contact, in case of requests by authorities this will lead to unforseen additional issues. Keep in mind the whole point of GPSR is to have a proper representation for market surveillance in case of issues with your products compliance
Who is responsible for labeling products with the responsible person details?
Sellers are responsible for providing and labeling their products with the responsible person details.
What specific documentation and labeling requirements are necessary for compliance with the GPSR?
Sellers must provide clear labeling that includes the responsible person's name and contact details, along with any necessary safety documentation required for the product.
Businesses must ensure that products do not pose a risk to the health and safety of consumers and that these measures are documented and easily accessible for regulatory inspection.
Once sellers add the needed information to their listings, will it be visible to buyers before purchase?
The added information will typically be visible to potential buyers before purchase, allowing them to assess compliance and make informed decisions prior to buying.
Will the GPSR regulations apply to sellers in the UK?

- Toys and Childcare Products: Products aimed at children are subject to strict safety standards, and any risks related to choking, toxic materials, or sharp edges could trigger recalls and stricter compliance checks.
- Electronics and Electrical Appliances: Items that pose electrical hazards or fire risks, such as faulty wiring or overheating, will face closer scrutiny under the GPSR.
- Personal Protective Equipment (PPE): Products like helmets, safety gear, and medical devices will need to demonstrate compliance with EU health and safety standards, especially if they are intended for critical use.
