Do I need an EU FBO if I’m outside the EU and want to sell food/ supplements in the EU?

Under EU law, a “Food Business Operator” is the person or company responsible for making sure food law is met in their food business. EURLEX

On the label, the EU requires that the name and address of the food business operator established in the EU or, if not, the importer is given. European Union

So if you are outside the EU and want to sell prepacked food into the EU:

  • You must have either

    • an EU-established FBO whose name and address are on the label, or

    • an EU importer whose name and address are on the label (they then become the responsible FBO in practice).

What exactly does the FBO do – is it just a mailbox or a real legal role?

The FBO is not just a “label” or mailbox.

A FBO is defined as the person or company responsible for ensuring that the requirements of food law are met within the food business under their control. EURLEX/GOVUK/FOODUK

Key responsibilities include:

  • Ensuring food is safe and complies with EU requirements (Articles 14–17). EURLEX

  • Having traceability so it’s possible to know from whom food was received and to whom it was supplied

  • Withdrawing/recalling unsafe food and notifying authorities if they believe their food is not in compliance or is unsafe (Articles 19–20). QASSURANCE

What obligations come with appointing an FBO? What do I (as brand) need to provide?

As the brand / non-EU seller, you typically must provide to the FBO:

  • Full product specs and ingredient lists

  • Allergen, nutrition and labeling drafts

  • Supplier / manufacturer details and traceability info

  • Information on storage/transport conditions

  • For some categories: lab reports, certificates, HACCP info, etc.

Because as the FBO we are legally liable, we will not just “lend their address” without approving your documentation.

Do supplements, teas, seeds, food-contact items etc. fall under FBO requirements?

The FBO concept applies to “carrying out any of the activities related to any stage of production, processing and distribution of food”.

“Food” in EU law is broad and includes:

  • Conventional food (snacks, honey, sauces, etc.)

  • Food supplements (vitamins, minerals, botanicals

  • Drinks/teas, herbal infusions

  • Seeds, nuts, flour, etc.

  • Online food sales and distance selling

So if these are sold for human consumption, an FBO needs to be involved and establishments must be registered with the food authority.
